Terms of Use Agreement
This Terms of Use Agreement is a contract between you the user, and SnailCard.
The agreement applies to your use of the SnailCard Service, and
any products of SnailCard. We encourage you to read the entire document
carefully as it affects your rights. By signing up for an account or
logging into your account, you state that you have fully read and agree
to the terms of this agreement and the terms of our Privacy
Policy. Any agreement changes will be posted here in this document.
In addition, you will be notified by E-mail of the changes. In the event
that you do not receive the E-mail for any reason, you will still be
able to view the "updated" Terms of Use Agreement in this document
at this location. Each time you log into your account, you state that
you agree to the current Terms of Use Agreement. You also state that
your account information is current. If at any time you are in violation
of this agreement, SnailCard has the authority to close your account,
with out notice, and with out returning the remaining balance to you.

A. Uploading and Managing Your Images
Our service allows you to upload and manage your images. By uploading
an image, you give SnailCard permission to use it royalty free, and
to print and send it through the mail. In addition, by uploading any
image, you state that the image is yours or that you have written permission
from the image owner. If any part of your uploaded images contains copy
written, or other legal protection not held by you the user, you are
in violation of this agreement. By uploading an image to our service,
you authorize SnailCard to automatically generate thumbnail versions
of your image and to crop your image to fit a 2:3 ratio of width to
height. You also authorize SnailCard to download the image to our system,
and save it for the purpose of printing, and for our records.
If your image has been deemed offensive by us (SnailCard), or the
USPS, then the image will be removed, any cards submitted to our service
with the image on it will be marked inappropriate and will NOT be sent.
This stands for any image even if it is NOT yours.
You the user have the option to allow other users to use your image
for the purpose of sending a SnailCard with our service. If you decide
to allow other users to use an image in our service, you agree that
you will NOT receive any royalties.
If you find any image through the postcards
section of our web site you agree that you will NOT copy or print this
image to your computer or any digital other media. These images are
protected legally by copyright of the image owner NOT SnailCard. Any
images other than those uploaded by our users are protected by SnailCard
copyright.
B. Your Account Balance
You are NOT required to keep a minimum balance in your account, and
no user is required to add credits to their account unless they intend
to send SnailCards. By adding credits to your account you agree to
pay SnailCard in the amount of $1.00 per credit minus any fees, charges,
and taxes. All reference to your balance in $ is a reference to equivalent
credits. In the event that you decide to close your account, you will NOT
be refunded any remaining credits.
By adding credits to your SnailCard account, through the PayPal
service, you are bound to their User Agreement, Privacy Policy, and
any other agreements, or requirements held by their service. You can

C. Sending SnailCards
By sending postcards from you SnailCard account, you agree that no
illegal information is being sent. In addition, your Image, and verbal
content must NOT be offensive to the general public. In the event that
the USPS decides that a card is unfit to be sent for reasons of content
then the card will be marked inappropriate, and will NOT be sent. It
will be kept on our records, and you will NOT receive a refund for the
credit amount of the card. In the event that the USPS or we (the SnailCard
staff) finds your image to be offensive, it will be removed.
It is our policy NOT to read the message text of any sent cards. However,
we do scan them to ensure there are no printing errors, and know that
these cards are sent open faced, without an envelope. For this reason,
you should NOT send any venerable information such as Credit Card Numbers,
Passwords, or any other private information you would not want your
postman (or postwoman) to read. We can NOT be held responsible for any
content sent through our service, as we do not scan the cards for content.
Any information you send is at your own risk, and no protection is
given by SnailCard, or the USPS.
SnailCard offers no guarantee or warranty on your card after it has
been placed in the mail. If you card is not delivered correctly, or
you believe that it was not delivered correctly, please notify us, so
that we can work with the USPS to resolve this problem. If you did not
fill out the correct address when sending the card, you are at fault.
We encourage you to double check your recipients address before sending
any SnailCard.
D. Your Personal Information
The information we collect on you is for your protection and our protection
against fraud. This information will NEVER be sold, shared, or rented
to any third party companies.
We require that you provide a valid E-mail address, in order to send
you updates on our Privacy Policy. We may also send you other information
about our service, or reminders from time to time. We will NEVER send
third party advertisements. Your E-mail address must be confirmed before
your account is activated. In order to confirm your E-mail address,
you must click on the link sent to you after you sign up for an account.
Your first, and last name are required along with your full address
for future services where users will be able to select if they would
like to be listed in the SnailCard directory in order to easily send
SnailCards to people even if you don't know their full address. This
will be an opt in service, but you information is still needed. This
information may also be used by SnailCard to verify your account.
You phone number may also be submitted to us at your discretion. Your
phone number will only be used to contact you if you have requested
to be contacted by phone. If you do provide your phone number to us,
you state that it is your current phone number.
A password and username are also required to protect your account.
